The French DPA (CNIL) is now empowered to take legal action to obtain a court injunction ordering the deletion of minors’ data, on an online platform for example.

The new law amends article 21 of the French transposition of the GDPR (i.e. LIL) and introduces a new summary procedure thank to which the President of the CNIL can now, in the event of failure to comply with or to respond to a request for the deletion of personal data concerning a minor, ask the competent court to order any measure necessary to safeguard these rights and freedoms (under penalty of law, if necessary).
