Our partner Julie Carel had the pleasure of speaking at the PERIFEMDAY roundtable on augmented video surveillance, alongside Member of Parliament Paul Midy, Vincent Magnon (ANAVEO GROUP), Franck Charton (Perifem, the Technical Federation of Commerce), and Florian Bousquet (Carrefour).

This was an opportunity to revisit the proposed law aimed at regulating retailers’ use of automated video analysis tools to combat theft, which was adopted on February 16 by the National Assembly with a large majority and is now proceeding through the Senate.

This proposed law undeniably moves toward greater legal certainty for industry stakeholders, including retailers and providers of innovative security solutions:

⚫ Augmented video surveillance lies at the intersection of three complex areas of legislation (security, personal data, and artificial intelligence), and a dedicated law helps establish a precise framework and limit divergent interpretations;

⚪ This proposed law provides an opportunity for a democratic debate on the topic of augmented video surveillance to combat in-store theft, something the CNIL has been calling for for several years;

⚫ The precise and detailed nature of this proposed law—which will be supplemented by an implementing decree—allows for the establishment of harmonized technical and organizational conditions to create a clear standard.

If this proposed law were to be adopted as is, it would create an experimental framework until the end of 2027, with the aim of allowing stakeholders to demonstrate the usefulness and proportionality of this type of solution.
